Drug Charges Dismissed Against Vermiglio, Kuhn, Sweezy

Smoke 'em if you got 'em.

Three football players from North Carolina State University cited on drug charges in April had their charges dismissed in court Tuesday.

Jake Vermiglio, Markus Kuhn, George Bryan and J.R. Sweezy were charged with possession of marijuana and drug paraphernalia. Vermiglio, Kuhn and Sweezy faced a judge Tuesday. A hearing on Byran’s charges was postponed to a later date.

Defense attorneys argued the arrests resulted from an illegal search. A Raleigh police officer working off-duty at the College Inn Apartments April 24 searched an apartment there after he smelled what he thought was marijuana, according to the search warrant in the case

Judge Keith Gregory ruled the officer’s entry into the apartment was not lawful.

So that takes care of the possession charges. The charge against George Bryan--maintaining a dwelling for the purpose of using a controlled substance--will be handled at a later date and I guess could be a problem for Bryan. But I really have no idea. (Is there a lawyer in the house?)

Vermiglio and Kuhn will most likely avoid suspension thanks to this ruling...unless TOB decides he still needs to send a strong message.
